A UNION

RAILWAY LABOR ACT

The Railway Labor Act guarantees employees the right to be represented by a representative of THEIR OWN CHOOSING.

In 2019 the Rules for Railroad and Airline employees were revised and allow for employees to get free of a union they do not want by filing for an election with the National Mediation Board (NMB).

1.    The first step is to get at least 50% of all the employees who work under the Union labor contract to sign what is known as an AUTHORIZATION CARD.

a.     Because sometimes workers are at several locations you may think that is imposable, but you can do it.  Talk to a likeminded worker in another work facility of your company and ask WORKERS for help.  Ask friendly WORKERS to get workers to sign cards for you.

b.    NEVER ASK ANYONE IN MANAGEMENT TO GIVE YOU HELP HAVING CARDS SIGNED.  Only workers can ask other workers to sign cards.

c.     Cards must have the exact and proper wording on them so attached is a cad you can print on plan paper and that card has the proper wording on it so you will get it right.

d.    You have about a year to get enough signed cards so there is no rush, but you should get them all as soon as you can.  Once you have 50% of the employees to sign cards you go to step 2 below.

e.     For a  vote application to work, you must have over one half of all the employee fill out and sign the authorization cards.

                                                 i.     This means that if there are 100 employees in the union (100 workers) then at least 51 workers must sign a card before you go to step 2. People who sign do not have to be members of the union, but they only need to be paid under the contract or be part of a "unit".

                                               ii.     If there are 10 workers, then at least 6 workers must sign cards before you go to step 2.

                                             iii.     No worker should fill out and sign more than one card. (One person - one vote).

f.      Obviously, the more workers that sign cards, the more forceful it is. So, you need to get as many signatures on cards from workers as you can.

2.    the 2^nd  step is for an employee to fill out a form called Investigation of Representation Dispute Form – NMB.  You can access this form at the button below or by going to the NMB website <<How to Apply for Representation – National Mediation Board (nmb.gov)>>

a.     The NMB form is difficult, however the form we have linked is simple to fill out – [you chose what you want as they are both the same].  The form we supply in the link below you just tab through the blanks and type in the needed information.  If you do not know the answer type in UNKNOWN.

b.    Once you have your cards and have completed your NMB request form go to step 3

 3.    Print TWO (2) copies OF your completed NMB Form.  Keep a copy of all your signed Authorization Cards along with a copy of your NMB Form
(you can print 3 copies and keep one for yourself – be sure to keep photocopies of your signed Authorization Cards).
